Reservation Consent* By submission of this Reservation Request for the MS-39, I understand and agree that this Promotion and any ensuing Purchase Agreement, or lack thereof, shall be forever and always remain between me, as the buyer, and MS-39 Representative, as the seller, and shall not constitute, implicate, or imply a contractual relationship with the Refractive Surgery Alliance Corporation, their executives, agents, representatives or otherwise, in any way whatsoever. I assume any and all liability when pursuing this Reservation Request with the MS-39 Representative. Furthermore, I shall hold harmless and indemnify the Refractive Surgery Alliance from and against, and shall compensate and reimburse the same for, any loss, damage, claim, liability, fee (including reasonable attorneys' fees), demand, cost or expense (regardless of whether or not such loss, damage, claim, liability, fee, demand, cost or expense relates to a third-party claim) that is directly or indirectly suffered or incurred by the Refractive Surgery Alliance, or to which the Refractive Surgery Alliance becomes subject, and that arises directly or indirectly from, or relates directly or indirectly to, any inaccuracy in or breach of any representation, warranty, covenant or obligation of this Reservation Request. This Release is irrevocable and will not terminate in any circumstances.
